Terms and Condition
"Terms of Service / Condition of Warranty"

Definitions. "Buyer" and "Customer" shall mean the person or entity described on the face hereof as the BUYER, or as the CUSTOMER. "Goods" shall mean the products described on the face hereof as being sold to BUYER, or the CUSTOMER.

Ultimate Custom Computers will not be held responsible for typographical errors, graphical errors or pricing discrepancies due to data entry errors. Any difficulties resulting from said errors will be corrected at the discretion of Ultimate Custom Computers.

Unless otherwise outlined below, Ultimate Custom Computers only supports the original manufacturer's warranty on products purchased from Ultimate Custom Computers. The warranty does not extend beyond the original Buyer of Products from Ultimate Custom Computers and Ultimate Custom Computers shall have no obligation to the Buyer with respect to providing any warranty on any Products for which Ultimate Custom Computers has not received full payment from the Buyer. In cases where the products manufacturer will work direct with end user, Ultimate Custom Computers customers may be referred directly to manufacturer for service. Software is non-returnable.

Computer Systems: Our computer systems have a three (3) year limited warranty covering parts and labor, And Lifetime technical support, with exception of a few components that are covered under warranty with the original manufacturer, as stated in the individual components specifications. These items are warranted for an average one year and include but not limited to: Case Lighting, Sound Card, Optical Drive (including Blu-ray), Card Reader and Floppy drive. All other components such as Motherboard, CPU, Power supply, Memory, Hard drive, Fax Modem, Video card and as such continue to be under full warranty for a minimum (3) years. Any defects in the unit will be repaired or replaced under warranty conditions by Ultimate Custom Computer only, and no 2nd or 3rd part repair facility or person. If the customer has a 2nd or 3rd party facility or person perform repairs or any work on a computer system within the (3) Three year warranty time frame, and without written permission from Ultimate Custom Computers, then Ultimate Custom Computers will have no further obligations for warranty or technical support on that computer. The warranty and technical support will be rendered void if there are any signs of tampering, over clocking or damage, or within terms stated in paragraph (8) eight and (10) ten of this Terms and Condition, Or what is considered to be normal wear and tear. This warranty is good for the original buyer of the item purchased and no second parties. The Buyer is responsible for all shipping charges related to returns unless otherwise agreed to by Ultimate Custom Computers in writing. Lifetime technical support is in effect for the lifetime of the computer and will be only on the original custom built computer sold, and only to the original customer and no second or 3rd parties, or hand-me downs to other people, and this lifetime tech support is not transferable. This lifetime technical support is supported through telephone, email or live chat as what is comfortable with the customer. Once the original computer is owned by a second party, any and all warranties and all technical support become VOID, and Ultimate Custom Computers will have no further obligations for warranty or technical support on that computer.

Money back guarantee: Ultimate Custom Computers guarantees 30-day money back on all computer systems, and 7 days on Barebones PC, monitors and other peripherals with a few limitations and exceptions. No returns allowed for credit or refund after the time limit has expired. These limits do not offset the warranty of the product. Ultimate Custom Computers will credit the item for other instore purchase if the original item is damaged, or refund the customers money originally paid for the item, minus a few exceptions including restocking fees and Other limitations: Shipping and handling costs are not refundable. Software or as the same is not refundable , Labor charges included in building computer systems are not refundable such as the "Standard system build rate" and any other special or extra labor performed on a computer as "modifying" or "customizing". For fuul refunds, All items must be in new, resalable condition, and have no physical damage, and no components missing or have been changed out, and all original components intact in the original condition. The merchandise including computers must be in new condition in functionality and appearance. All extras like CD's, manuals, cables, software including free game's and any extras originally shipped with the computer must be returned with the computer, as well as the same for any other item we sell. Restocking fees: All items are subject to a 15% restocking fee, including custom computers, as there is high depreciation with all computer electronics and thus our cost for these returns are mandatory. After the customer contacts Ultimate Custom Computers and receives an RMA number from Ultimate Custom Computers, the customer has 5 days to ship the item and provide Ultimate Custom Computers a tracking number for the item shipped in for possible warranty, otherwise all warranties and/or tech support might be subject to being void at Ultimate Custom Computers discretion.

Repair and Upgrade Services: Ultimate Custom Computers repair services carry a 90 day warranty on computer parts and labor only. This only covers the particular part and labor stated within the repair work order, that unless otherwise stated by Ultimate Custom Computers in writing. If anything wrong happens with any other part on the customers computer after the repair was made, whether the repaired/serviced parts are at fault or not, or other parts may or may not be mentioned in the repair work order are at fault, that causes failure to the repaired parts or any other parts not included in writing on the repair service work order, the warranty shall then be deemed waived, and Ultimate Custom Computers shall have no further obligation to the customer. Ultimate Custom Computers will not be held responsible for any data loss, damage to personal or business files, faulty parts or data integrity loss as a result of faulty components prior to any work being performed by Ultimate Custom Computers.

Ultimate Custom Computers does not support the manufacturer’s warranty on any Product beyond one (1) year unless otherwise stated. For any manufacturer who offers a warranty on Products exceeding limited warranty and or one (1) year, it is the Buyer’s responsibility to deal directly with the manufacturer for any repairs of the Product beyond the first year of warranty. Manufacturer's return policies may differ from Ultimate Custom Computers and should the manufacturer have a warranty or policy change, Ultimate Custom Computers will abide by their changes when it affects Ultimate Custom Computer's first year warranty coverage.

Ultimate Custom Computers does not warranty any products that have been subject to improper use, modifications, physical damage or abuse such as customer negligence to perform routine "Regular PC Maintenance". Removal of any serial number or warranty labels or security "tamper proof" labels, thus will void all warranties and any future technical support. Any shipping damage or loss that might occur is the sole responsibility of that shipping courier and not the responsibility of Ultimate Custom Computers. Ultimate Custom Computers will do its best to help the customer remedy the situation if such event does occur.

Force Majeure: Ultimate Custom Computers shall not be held responsible for any failure of performance to make timely delivery of all or any part of the Goods in the event such failure was due in whole or in part, to federal, state or municipal action, stature, ordinance or regulation, strike or other labor trouble, crime, acts of nature such as flooding, earthquakes, tornadoes, hurricanes, snow and ice, mudslides, fire or other damage to or destruction of, in whole or in part, the Goods or the manufacturing facility for the Goods, the lack of or inability to obtain raw materials, labor, fuel, electrical power, water or supplies, or any other cause, contingency or circumstances within the United States of America not subject to the control of Ultimate Custom Computers, which cause or hinders the manufacture or delivery of Goods.

Any alterations, modifications, additions, improvements, installation, general tampering with or attachments on computers or products sold by Ultimate Custom Computers and not authorized in writing by Ultimate Custom Computers shall solely be at the Buyer’s own expense and risk, and Ultimate Custom Computers shall have no further obligation to the Buyer with respect to providing any warranty or technical support on the computer or product. Any damages arising from acts of nature, terrorism or direct acts of war are not covered under this warranty policy. Acts of nature is defined as flooding, electrical shorts, power outage or "spikes" from AC current, tornadoes, hurricanes, extreme humidity, snow, fire, rain and such as this.

Disclaimer of Warranty/Limitation of Liability: Except for the express warranties contained in this Warranty Statement, Ultimate Custom Computers disclaims all other warranties and conditions, express or implied, including but not limited to, any implied warranty of merchantability or fitness for a particular purpose or non-infringement. The right to return defective Products, as described herein, shall constitute Ultimate Custom Computer's sole liability and the Buyer’s exclusive remedy in connection with any claim of any kind relating to the quality, condition or performance of any Products, whether such claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, or otherwise.
ULTIMATE CUSTOM COMPUTERS SHALL NOT BE LIABLE UNDER ANY CIRCUMSTANCE TO THE BUYER OR ANY OTHER PARTY FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE COMPUTERS, PRODUCTS, REPAIR SERVICES OR OTHERWISE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOST PROFITS, LOSS OF THE PRODUCTS OR ANY ASSOCIATED EQUIPMENT, COST OF CAPITAL, COST OF SUBSTITUTE OR REPLACEMENT EQUIPMENT, FACILITIES OR SERVICES, DOWN TIME, BUYER’S TIME, LOST DATA, INJURY TO PROPERTY OR PERSON'S OR ANY DAMAGES OR SUMS PAID BY THE BUYER TO THIRD PARTIES, EVEN IF ULTIMATE CUSTOM COMPUTERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY SHALL APPLY WHETHER ANY CLAIM IS BASED UPON PRINCIPLES OF CONTRACT, WARRANTY, NEGLIGENCE, OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, THE FAILURE OF ANY LIMITED OR EXCLUSIVE REMEDY TO ACHIEVE ITS ESSENTIAL PURPOSE, OR OTHERWISE.
The laws of some jurisdictions limit or do not allow the disclaimer of consequential damages. If the laws of such a jurisdiction apply to any claim by or against Ultimate Custom Computers, the limitations and disclaimers contained herein shall be to the greatest extent permitted by law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so that the above may not apply to the Buyer.
IN NO EVENT SHALL ULTIMATE CUSTOM COMPUTERS BE LIABLE TO THE BUYER OR ANY OTHER PARTY FOR LOSS, DAMAGE, OR INJURY OF ANY KIND OR NATURE ARISING OUT OF OR IN CONNECTION WITH THESE TERMS AND CONDITIONS IN EXCESS OF THE NET PURCHASE PRICE OF THE PRODUCTS ACTUALLY DELIVERED TO AND PAID FOR BY THE BUYER, OR THE ACTUAL COST OF THE REPAIRED COMPUTER AT TIME OF REPAIR WAS MADE. ULTIMATE CUSTOM COMPUTERS SHALL HAVE NO DUTY TO DEFEND, INDEMNIFY, OR HOLD HARMLESS THE BUYER FROM AND AGAINST ANY OR ALL DAMAGES OR COSTS INCURRED BY THE BUYER ARISING FROM THE INFRINGEMENT OF PATENTS OR TRADEMARKS OR VIOLATION OF COPYRIGHTS BY ANY OF THE PRODUCTS.
